Options To Help Families Stay Together

One of the easiest and fastest ways to join your loved ones in the United States is through a family-based visa.

To do this, a family member that is a US citizen or lawful permanent resident will need to sponsor you and petition for you to be allowed to immigrate to the country. If you don’t qualify for a family-based visa, but joining your loved one in the country is your priority, you should talk to one of our compassionate immigration attorneys to see what other options might be open to you.

Green Card Through Family-Based Visas

When it comes to family-based immigrant visas that can offer the benefit of lawful permanent resident status (a green card), there are two distinct categories. Which category you fall under depends on your relationship with the family member who intends to sponsor you. The categories for obtaining a family-based immigrant visa are “immediate relatives” and “family preference.”

To apply for immediate relative or family preference immigrant visas, you can follow the steps outlined by USCIS, but your best chance of being approved for a family-based visa is to get the help of a skilled immigration attorney

Immediate Relative Immigrant Visas

Immediate relative immigrant visa types are based on a close family relationship with a US citizen. The number of immigrants visas granted in these categories is not limited.

Immediate relative visa types include:
  • IR-1: Spouse of a US Citizen
  • IR-2: Unmarried Child Under 21 Years of Age of a US Citizen
  • IR-3: Orphan adopted abroad by a US Citizen
  • IR-4: Orphan to be adopted in the US by a US citizen
  • IR-5: Parent of a US Citizen who is at least 21 years old

Family Preference Immigrant Visas

These types of visas are for some other family relationships with a U.S. citizen and some specific family relationships with a lawful permanent resident. These types of visas also offer the immigration benefit of lawful permanent resident status. There are a limited number of these visas available each year in each category.

The family preference categories are:
  • Family First Preference (F1 Immigrant Visa): Unmarried children of U.S. citizens.
  • Family Second Preference (F2 Immigrant Visa): Spouses, unmarried children under age 21, and unmarried children (age 21 and over) of green card holders.
  • Family Third Preference (F3 Immigrant Visa): Married children of U.S. citizens.
  • Family Fourth Preference (F4): Siblings of U.S. citizens, and their spouses and minor children, provided the U.S. citizens are at least 21 years of age. (65,000)

Unfortunately, grandparents, aunts, uncles, and cousins can’t sponsor their family members, but there may be other visas that could help you get into the country to be with your family. Your immigration attorney can help you figure out what options are available to you.

Fiancé(e) Visas

Fiancé(e) visas can help you (and even your children if they are under 21) join your betrothed in the United States. 

Your sponsor has to be a U.S. citizen, and other several eligibility requirements exist.

You are both legally allowed to be married

You’ve met in person at least once in the past two years

Your marriage will happen inside the United States
