Hi, Leslie Howard here with D’Alessio Law, and I am here today to talk to you about the L-1A visa.
The L-1A is available to managers and executives, or people who are starting a new office in the United States.
One of the main requirements for the L-1A is that the employee must have worked in a managerial or executive capacity in a foreign company for at least one of the last three years, and then is moving to a domestic company that is affiliated with that foreign company.
So an executive is an officer of the company, and a manager is a manager of either people or processes.
Normally, for a manager of people, we like to see an org chart that shows where the individual falls in the pecking order of the company. And for a process manager, we look at flow charts to determine which processes that person manages.
So some problems that can arise with an L-1A case would be if the domestic company is not properly affiliated with the foreign company. We can look at the corporate documents to determine that, or if the person is not truly a manager or an executive. So we look closely at the job description to make sure that it falls in line with a manager or executive role.
We’ve done several L-1As this year alone. We’ve done new offices for people who are starting new companies here in the U.S., and traditional transfers for companies that already exist in the U.S. And it’s really been a great tool for our clients to relocate to the United States and even bring their families.
The other nice thing about the L-1A visa is that the spouse of an L-1A visa holder is able to work incident to their status without having to apply for an employment authorization card, which is not the case for all non-immigrant visas. So it’s a really great family visa as well.
